Mental Health Care Power of Attorney
This document is similar to the Health Care Power of Attorney, but it is specifically for a mental health crisis event, which can happen because of certain types of dementia, a head injury, or a psychotic break caused by an underlying medical condition such as bipolar disorder or schizophrenia. The purpose of this document is to designate someone else, your Agent, to make treatment decisions for you in the event of a mental health crisis. A Mental Health Power of Attorney provides flexibility to deal with a situation as it occurs rather than attempting to anticipate every possible situation in advance.
This document allows you to make your choices known regarding mental health treatment in the event that you unable to make decisions for yourself during a mental health crisis event. In effect, you are making decisions about treatment before the time that you will need it. This allows you to make more informed decisions and to make your wishes clearly known. Before this document will take effect, incapacity will need to be determined by examination from a psychiatrist AND one of the following: another psychiatrist, psychologist, family physician, attending physician or mental health treatment professional.
